Terms and Conditions for Using “My Wijhat” Services

1. Introduction

By accessing and using the “My Wijhat” platform (mobile app or website), you agree to comply with the following terms and conditions. This agreement constitutes a legally binding contract between you and First Destinations App for Tourism Co., and applies to all types of users, whether you are an individual customer, a service provider, or a visitor.

2. Definitions

• Platform: Refers to the “My Wijhat” website and mobile application, including all its digital and technological services.

• Company: First Destinations App for Tourism Co. – Kingdom of Saudi Arabia.

• Customer: Any user who books or benefits from services offered through the platform.

• Service Provider: Any third party offering tourism, hospitality, or entertainment services via the platform.

• Support Service Providers: Entities providing auxiliary services or products such as maintenance, cleaning, training, etc.

• Visitor: Any user browsing the platform without creating an account or making a booking.

• Services: Include but are not limited to: hotel bookings, restaurant and café reservations, car rentals, boat bookings, tours, event ticketing, and business space bookings.

3. Nature of “My Wijhat”

“My Wijhat” is a digital platform that acts as a technical intermediary between the customer and the service provider. The company does not own or operate the listed services and does not guarantee their execution. It only facilitates access, booking, payment, and communication between the parties.

4. Platform Usage Conditions

• Users must be at least 18 years old.

• Users must provide accurate and up-to-date information when creating an account or making a booking.

• The platform may not be used for illegal purposes or in violation of public morals or local regulations.

• The company reserves the right to suspend or delete any account that violates the terms without prior notice.

5. Booking and Payment

• All bookings are made via the official website or mobile app.

• Prices include all applicable taxes and fees.

• All payment methods authorized within Saudi Arabia are accepted.

• Some services are confirmed instantly, while others require service provider approval.

6. Cancellation and Modification Policy

• Cancellation is not allowed within 48 hours of the service time.

• If canceled earlier, a full or partial refund may be issued according to the provider’s policy.

• The company is not liable for any fees due to late or unjustified cancellation by the customer.

• If the booking is canceled at least forty-eight (48) hours prior to the service time, the customer shall be entitled to a full or partial refund in accordance with the service provider’s cancellation policy. The refund shall be processed within seven (7) to fourteen (14) business days using the same payment method used at the time of booking.

   

• If the booking is canceled by the “My Wijhat” platform or by the service provider for any reason not attributable to the customer, the customer shall be entitled to a full refund without any deductions, which shall be processed within seven (7) to fourteen (14) business days using the same payment method.

   

• The Company shall not be held liable for any delays in the refund process resulting from the service provider, payment service provider, or banking procedures beyond its control.

7. Specific Conditions by Service Type

Hotel Bookings

• Prices include tax and service charges.

• Customers must comply with hotel policies (e.g., check-in rules, age restrictions, no smoking, etc.).

Restaurant and Café Bookings

• The reservation guarantees the table only; meals and drinks are not included.

• Bookings are automatically canceled if the customer is over 15 minutes late.

Car Rentals

• Cars are rented through licensed providers.

• The customer is the driver and must hold a valid driving license.

• Prices may include fuel and insurance, depending on the offer.

Boat Bookings

• Customers must comply with safety and marine regulations.

• The company is not responsible for weather conditions or sailing bans.

Tours and Experiences

• Tours may be private or group-based; details are clarified before booking.

• The company does not guarantee guide availability or itinerary completeness.

Event Tickets

• Tickets are non-refundable and non-transferable after purchase.

• The company complies with the event organizer's terms only.

Business Space Bookings

• Includes office rooms, meeting rooms, and workshops.

• Pricing is based on hourly or daily rental.

8. Conditions for Different User Types

1. Customers

• Responsible for the accuracy of registration and booking information.

• Must pay all required fees on time.

• Must comply with service provider policies listed in the booking.

• Fraud or misuse is prohibited.

• Must adhere to the platform’s cancellation and refund policy.

2. Service Providers

• Must be licensed and authorized to provide the listed services.

• Responsible for delivering services as advertised.

• Must keep information updated and booking availability in real-time.

• Must handle customers professionally and legally.

• The company reserves the right to suspend or terminate a provider account for violations.

3. Visitors

• May browse the platform for personal purposes only.

• Cannot make bookings or submit service requests without creating an account.

• The company may block or restrict any visitor who misuses the platform.

9. Customer Responsibilities

• Customers must provide correct information and follow booking timelines.

• Fraud or manipulation in using services is prohibited.

• Any additional charges resulting from delays or changes are the customer’s responsibility.

10. Intellectual Property & Platform Rights

• All rights to the platform are reserved to First Destinations App for Tourism Co.

• No content may be copied, altered, distributed, or used commercially without prior permission.

• Registration of the brand “My Wijhat” or similar names is prohibited.

• Violations of intellectual property rights are subject to legal accountability under Saudi laws.

11. Limitation of Liability

• The company is not responsible for the quality of services delivered by providers but strives to ensure minimum standards.

• The company is not liable for delays, cancellations, or service failures.

• The platform acts only as an intermediary; disputes between customers and providers are not the company’s responsibility unless caused by a technical fault.

12. User Content

• Users may post reviews and comments, provided they are not offensive or illegal.

• The company may reuse this content for marketing without compensation.

• Uploading content that infringes on third-party rights or promotes prohibited activity is strictly forbidden.

13. Changes to Terms and Conditions

• The company reserves the right to update these terms at any time without notice.

• Continued use of the platform constitutes acceptance of any modifications.

14. Privacy and Data Protection

• The company does not sell or share personal data with third parties except the relevant service provider.

• Data is stored securely using advanced digital protection measures.

• Customers may request full deletion of their accounts and content.

15. Governing Law

This agreement is governed by the laws of the Kingdom of Saudi Arabia. Any dispute shall be referred to the competent courts in Al-Madinah Al-Munawwarah.

16. Terms for Support Service Providers

These apply to all individuals or entities providing auxiliary, logistical, or operational services to the platform or registered providers (e.g., maintenance, cleaning, training, hospitality, IT systems, delivery, supplies, beverages, photography, etc.).

• Agreement and Registration
  Providers must have a formal agreement or platform approval before offering services.

• Compliance
  Providers must comply with all applicable Saudi regulations and the policies of First Destinations App for Tourism Co.

• Quality and Reliability
  Providers are fully responsible for service quality, adherence to deadlines, safety, and warranties.

• No Direct Customer Contact
  Providers may not communicate directly with customers, promote their own services, or accept off-platform bookings.

• Confidentiality and IP
  All information obtained during service execution is confidential and may not be disclosed or reused.

• Termination
  The company reserves the right to suspend or terminate cooperation with any provider who breaches these terms, with no compensation.
